Terms of Service

Please read these terms carefully before using our services.

1. Acceptance of Terms

By accessing or using the EXPX Estates website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and applicants.

2. Nature of Services — Seller Financing by a Private Owner

EXPX Estates is a private property owner ("for-sale-by-owner") offering seller financing on property held for investment. We are not a licensed real estate broker, mortgage lender, mortgage loan originator ("MLO"), mortgage broker, bank, credit union, or financial institution, and nothing on the Site is a commitment to lend, an offer of credit, or a consumer-loan solicitation.

Because we finance at volumes below the thresholds set by the federal SAFE Act (12 U.S.C. §5102; 12 CFR Part 1008) and the Dodd-Frank Title XIV seller-financer framework (see 12 CFR §1026.36(a)(4)–(5)), we may extend seller financing on property we own without MLO registration. Transactions that fall outside that narrow exemption — for example, owner-occupied consumer-purpose financing with a balloon payment — must be originated by a licensed Residential Mortgage Loan Originator, and we will refer applicants to one. Owner-occupant consumer-purpose mortgages are not offered through this Site. Owner financing is a private transaction between the seller and buyer; all figures on the Site are illustrative and subject to negotiation and final written agreement.

  • Payment estimates are calculated using standard amortization formulas and are approximations only.
  • Balloon payment amounts and dates are estimates based on the selected term.
  • Final terms are established only in a signed land contract or purchase-and-financing agreement.

2a. Equal Credit Opportunity & Truth-in-Lending Advertising

Equal Credit Opportunity Act. The federal Equal Credit Opportunity Act (15 U.S.C. §1691) and Regulation B (12 CFR §1002) prohibit creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract); because all or part of an applicant's income derives from any public-assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law as to this creditor is the Federal Trade Commission, Consumer Response Center, 600 Pennsylvania Avenue NW, Washington, DC 20580.

Adverse Action Rights. If we take adverse action on a financing request, you are entitled under 15 U.S.C. §1691(d) and 12 CFR §1002.9 to a written statement of the specific reasons for the action within 30 days of our decision, at no cost to you.

Advertising Disclosure (Truth in Lending, 12 CFR §1026.24). All rate, down-payment, term, and payment figures on the Site are representative examples for illustrative purposes only. Rates are fixed at contract signing. Figures do not include property taxes, hazard insurance, HOA dues, or closing costs. No figure on the Site is a commitment to lend.

2b. Property-Condition Disclosures

Lead-Based Paint (42 U.S.C. §4852d). Housing built before 1978 may contain lead-based paint. Before any purchase contract involving pre-1978 housing, you will receive the EPA pamphlet "Protect Your Family from Lead in Your Home," a disclosure of any known lead-based paint hazards, and a 10-day opportunity to conduct an inspection or risk assessment.

Ohio Residential Property Disclosure (O.R.C. §5302.30). Where required, a completed Ohio Residential Property Disclosure Form will be provided prior to execution of any purchase or land-contract agreement. Buyers are strongly encouraged to obtain an independent home inspection.

Photographs and descriptive copy on the Site are representative; all square-footage, bedroom, bathroom, tax, and HOA figures are approximate and must be independently verified.

3. No Real Estate, Legal, or Financial Advice

Nothing on this Site constitutes real estate, legal, tax, or financial advice. You should consult a licensed real estate attorney, certified public accountant, or HUD-approved housing counselor before making any real estate or financing decisions. A directory of HUD-approved counselors is available at hud.gov/findacounselor. EXPX Estates makes no warranty that any property is suitable for your needs or investment objectives.

4. Application Submissions

By submitting an application through this Site, you authorize EXPX Estates to:

  • Collect and store the personal information you provide.
  • Use the credit-score range you self-report to evaluate financing fit. Submitting the online application does not trigger any credit bureau inquiry. If your application advances toward closing, we will request your separate written consent before performing any soft or hard credit bureau inquiry.
  • Contact you via the phone number and email address provided.
  • Share your information with closing professionals (title company, escrow officer, attorney) you have authorized us to work with.

Submission of an application does not constitute an offer, commitment, or guarantee of financing. All applications are subject to seller review and final written approval.

5. Accuracy of Information

We strive to keep property information, pricing, and availability accurate. However, all property details — including price, condition, availability, and financing terms — are subject to change without notice. EXPX Estates is not liable for errors, omissions, or outdated information on the Site.

6. Intellectual Property

All content on this Site, including text, graphics, logos, and software, is the property of EXPX Estates or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

7. Fair Housing

We comply with the Federal Fair Housing Act (42 U.S.C. §3601 et seq.) and the Ohio Fair Housing Law (O.R.C. Chapter 4112). We do not discriminate on the basis of race, color, religion, sex (including gender identity and sexual orientation), familial status, national origin, disability, military status, or ancestry. If you believe you have experienced discrimination, you may file a complaint with the U.S. Department of Housing and Urban Development at hud.gov/fairhousing or the Ohio Civil Rights Commission.

8. Limitation of Liability

To the fullest extent permitted by applicable law, EXPX Estates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site.

Consumer carve-out. Nothing in these Terms limits or waives any right that cannot be limited or waived under applicable consumer-protection or housing law. The limitations in this Section 8 do not apply to: (a) personal injury or death caused by our negligence; (b) fraud or intentional misrepresentation; (c) gross negligence or willful misconduct; or (d) any statutory liability that cannot be waived under Ohio or federal law, including but not limited to rights under the Fair Housing Act, the Equal Credit Opportunity Act, the Ohio Consumer Sales Practices Act (O.R.C. Chapter 1345), and the Truth in Lending Act.

For all other claims, and only where enforceable, our aggregate liability for any Site-related claim is limited to the greater of (i) the amount you paid us in the twelve months preceding the claim, or (ii) one hundred U.S. dollars ($100).

9. Indemnification

You agree to indemnify and hold harmless EXPX Estates and its officers, directors, agents, and employees from any third-party claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your violation of these Terms or your unlawful use of the Site. This indemnity does not extend to claims caused by our own negligence or willful misconduct.

10. Electronic Communications & E-SIGN Consent

By using the Site and submitting any form, you consent to receive communications and required disclosures from us in electronic form (email, on-page notice, or PDF), and you agree that electronic records and electronic signatures satisfy any legal requirement that communications be "in writing," consistent with the federal E-SIGN Act (15 U.S.C. §7001 et seq.) and Ohio's Uniform Electronic Transactions Act (O.R.C. Chapter 1306). You may withdraw this consent at any time by emailing info@expxestates.com; withdrawal will not affect the validity of prior electronic records.

11. Email, Unsubscribe & CAN-SPAM

We send only transactional emails related to your application and optional informational newsletter emails to subscribers. Every marketing email includes a working unsubscribe link and our physical postal address, consistent with the federal CAN-SPAM Act (15 U.S.C. §7701 et seq.). You may unsubscribe at any time at /unsubscribe.html; we process unsubscribe requests within 10 business days.

12. Accessibility

We are committed to making the Site usable by people of all abilities and to substantial conformance with WCAG 2.1 Level AA and the Americans with Disabilities Act (42 U.S.C. §12101 et seq.). See our Accessibility Statement for our ongoing commitments and for how to report accessibility barriers.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. California residents have additional rights described in the California Residents section.

14. Changes to Terms

We may update these Terms at any time by posting the revised version on this page with a new effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law provisions. Except for claims that must, by law, be heard in a specific forum, disputes shall be resolved in the state or federal courts located in Lucas County, Ohio. Nothing in this Section 15 prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual-property rights or confidential information.
